Brazilian Court Upholds Dismissal of Employee Who Underwent Tanning Procedure During Medical Leave
In a recent ruling, the Regional Labor Court of Minas Gerais (TRT-MG) has upheld the dismissal of a woman employed at a bakery in Belo Horizonte. The employee was dismissed for just cause after it was discovered that she underwent a tanning procedure while on medical leave.
The first instance decision was made by Judge June Bayão Gomes Guerra, presiding over the 11th Labor Court of Belo Horizonte. An appeal was filed, but judges from the 6th Panel of the TRT-MG upheld the decision.
According to the court documents, the employee's medical certificate justified her absence from service but did not prevent her from returning to work if there was an improvement in her health. However, the aesthetic tanning procedure has the adverse effect of possible dehydration, which is incompatible with the gastroenteritis reported in the medical certificate.
The magistrate ruled in favor of the company, stating that the employee's behavior was serious enough to break the indispensable trust necessary to maintain the employment contract. The judge's opinion stated that the employee's attitude showed a lack of interest in her work, causing the break of essential trust in the employment relationship.
The magistrate did not accept the worker's arguments, stating that if she was well enough to undergo a tanning procedure, she was well enough to work. The magistrate clarified that the case was not one of a false medical certificate, but of the worker's condition to perform her professional activities, but using the certificate to fail to fulfill her obligations.
As a result, the employee did not receive rights such as notice pay, proportional 13th salary, proportional vacation pay plus the constitutional third, FGTS, and 40% indemnification, and unemployment insurance. The sentence confirmed the just cause and ruled that the request for reversal of the unjustified dismissal was unfounded.
This case highlights the importance of employees adhering to the terms of their medical leave, as any activities incompatible with the declared medical condition can potentially justify dismissal for just cause. Employers are advised to verify and document the employee's activities during medical leave, follow due process to prove inappropriate conduct, and ensure that the dismissal procedure respects legal requirements to avoid disputes.
