Alrighty, here's the deal. A tobacco wholesaler wanted to slap some flavors on their cigarette packs, but that's a big no-no, story of my life, right? Anyways, this wholesaler and a tobacco shop in Austria got busted, and the manager was p-o-ed about the fine. But the Austrian Administrative Court in Vienna put the kibosh on their case and asked the big kahuna, the EU's European Court of Justice (ECJ), for help.

You see, the directive from the EU on tobacco products ain't so clear-cut in Austria about what it means to plop a product on the market. And the Austrian court wanted to know: Does this restriction on putting flavor-infused packs on the market only apply when the cigarettes are sold to consumers, or does it cover the whole supply chain?

And the ECJ was like: "Nah, this bizness ain't just about handing over the cigarettes to your buddy. If we said it only applied at the final sale, folks could wind up with non-compliant cigs and risk harming themselves. People gotta know what they're smokin', ya feel me?"

So, now it's up to the Austrian court to hash out the legal beef between the tobacco wholesaler and the authorities, keeping in mind the ECJ's sage advice.
