Soaring Temperatures and Workplace Safety: Here's What You Need to Know 🚀

Kazakhstan is currently sweltering under a fierce heatwave, with mercury crossing +40°C in certain regions. In the midst of this scorching weather, it's important to consider workplace safety guidelines.

Christina Grinberg, a legal expert, shared with us some vital information on how employers should ensure a safe and healthy working environment during such extremes. According to the Labor Code of Kazakhstan, employers are bound to implement appropriate measures when the temperature at the workplace tips above the acceptable mark.

"If the thermometer reads beyond the normal limits at the workplace, employers are supposed to curtail working hours or offer extra breaks, grant access to cool water, shade, and so on. Employers must pay special attention to outdoor professions such as construction works, delivery personnel, and utility services. Failure to implement these protective measures warrants the right for employees to refuse work that compromises their life and well-being, and report the matter to the labor inspectorate. Such a refusal would make any dismissal illegal," Grinberg indicated.

In line with the Minster of Health's directive dated February 16, 2022, the ideal temperature for outdoor activities ranges between +15°C and +26°C. If the conditions exceed these limits, employers are responsible for enforcing extra precautions.

Grinberg further highlighted that employers should:

  • shorten shifts, particularly during peak temperature hours
  • sanction regular technological breaks
  • ensure access to potable water and cooling amenities like shade, shelters, and fans
  • provide personal protective gear, such as headgear, light-colored workwear

Items ignored may lead to legal repercussions as they could amount to the creation of harmful working conditions.

"Employers should document the safety measures they implement to preempt potential disputes and demonstrate diligence during inspections. Employees must be informed of their rights and encouraged to report violations to the Department of State Labor Inspection of the Ministry of Labor and Social Protection," Grinberg reiterated.

Employees, too, have a part to play in safeguarding their health. They should follow safety measures such as wearing headgear, keeping themselves hydrated, and avoiding strenuous activity during peak heat hours.

The Emergency Situations Committee has also offered advice for general safety: limit outdoor activities during the hottest hours, avoid intense exercise, maintain ample hydration, swim only at beaches equipped for safety, and never leave children unattended near water.
